Security of Payment

The South Australian Building and Construction Security of Payment Act 2009 came into force on the 10th December 2011 and under this legislation a large number of building and construction activities have been given increased statutory rights to receive fair and timely payments for works performed, or goods or services provided.

Edward Sain & Associates have been at the forefront of the implementation of this Act and offer services which in many cases will be the easiest and cheapest way to deal with Payment Claims and avoid issues associated with payments and having monies outstanding.

The best way is, where possible; avoid getting yourself in a situation where you are at a disadvantage by using Edward Sain & Associates to assisting you in;

  • Providing independent contract reviews and advice before you sign or accept an agreement or contract to minimise your risk and exposure to a level that is reasonable and manageable.
  • Providing advice and assisting  you to understand your rights and obligations under the terms of the agreement or contract you have  with your client and  how this impacts on requirements under the Building and Construction Security of Payment Act 2009 legislation
  • Providing assistance in liaison with your clients to minimise the potential for litigation, which can be expensive and time consuming when compared to utilising the provisions of the Security of Payment Act.
